AGREEMENT RELATING TO
BURTON BRADSTOCK LIBRARY
THIS AGREEMENT is made this day of 2010
BETWEEN
(1) Burton Bradstock Parish Council (a body corporate formed pursuant to the provisions of the Local Government Act 1972) care of the Chairman to the Council Burton Bradstock Bridport Dorset (Ôthe Parish CouncilÕ) and
(2) Sandra Jacqueline Adderley of 103 Southover Burton Bradstock Bridport Dorset, Robert James Hynds of Summers Hill Shipton Lane Burton Bradstock aforesaid, Anne Maureen Miller of 5 Howarth Close Burton Bradstock aforesaid, and Robert Ian Wigglesworth of 9 Northover Close Burton Bradstock aforesaid (together known as the trustees of the Friends of Burton Bradstock Library (Ôthe FriendsÕ)
IT IS AGREED as follows:
1.
DEFINITIONS
1.1 ÒThe ProjectÓ means opening running and managing the Library building at Church Street Burton Bradstock, Dorset (Òthe LibraryÓ)
1.2 The Community Use Agreement means a Community Use Agreement relating to Burton Bradstock library dated 2010 and made between (1) Dorset County Council and (2) The Parish Council
2.
ASSISTANCE IN THE PROJECT
2.1 The Friends will assist the Parish Council in the Project assuming responsibility for the management of the Library as agreed from time to time and by raising funds to be used for that purpose either by the Friends or by the Parish Council
2.2 In pursuance of 2.1 above the Friends will not carry out any activities in furtherance of the Project that are contrary to the FriendsÕ charitable status or the constitution of the Friends and the Parish Council will not require the Friends to do so
2.3 The Parish Council agree and undertake that all funds raised by the Friends and donated to the Parish Council will be used solely in accordance with the Friends constitution and its charitable purposes.
2.4 The parties agree that subject to the above sub clauses of this Clause 2 they will endeavour to further the purposes of the Community Use Agreement and the Friends will carry out the functions listed in the Schedule hereto insofar as those purposes are not contrary to the constitution of the Friends or its charitable status.
3.
TERM
This agreement shall continue until either party serves on the other 3 months written notice to terminate it, such notice to be served on the Clerk to the Parish Council if served by the Friends or on two of the trustees of the Friends if served by the Parish Council.
4. NO PARTNERSHIP
Nothing stated in this agreement shall be construed as creating a partnership between the parties or the relationship of landlord and tenant.

THE SCHEDULE
Building
Support
Appointing a Building Manager (with a deputy to cover for absences e.g sickness, holidays) who will assume responsibility for the building.
The Building Manager will maintain a building status logbook to track any immediate maintenance/fault problems. These problems will be corrected promptly.
The Friends will provide a contingency/support fund to deal with any minor unscheduled maintenance occurrences.
Once a year an independent reviewer will visit the building to identify any potential long term problems that could need substantial funding to correct. Where necessary the Friends would organise a fund raising campaign to raise adequate funding.
Cleaning
The Friends will organise volunteer cleaners who will match the current cleaning regime operated by the Library Service. Funds will be provided to meet any external cleaning services required e.g window cleaning.
